Facts

Appellant was charged with three offences contrary to section 325 of the Criminal Code, namely dangerous driving and causing death by dangerous driving. Appellant drove his lorry in a zigzag manner thereby collided with an oncoming pick up van, from the opposite direction, driven by the deceased. Two persons in the pickup van died at the spot. Appellant however, claimed that he crossed the road and parked his lorry when the pickup van ran into his lorry and hit his vehicle. Appellant was found guilty. Dissatisfied with the judgment, the appellant appealed to the court of Appeal.
